Significatividad en una investigación de libre competencia

El Departamento de Derecho Económico invita a participar en el Centro de estudios: “Alcance y parámetros para que un comportamiento sea considerado significativo y la procedencia del recurso de reposición frente al acto de apertura de investigación”.

Las normas de competencia indican la importancia del elemento Â“significativoÂ” para la procedencia de una investigaciÃ³n. La Superintendencia de Industria y Comercio en un reciente fallo indicÃ³ que dicho elemento no se discute al momento del fallo sino en la apertura.

En ese sentido, bajo norma administrativa procede el recurso de reposiciÃ³n contra el acto de apertura de investigaciÃ³n, pues dicho acto estÃ¡ decidiendo de fondo si la investigaciÃ³n es significativa. De otro modo quedarÃa sin posibilidad de contradicciÃ³n el investigado. Entonces: Â¿quÃ© es significativo?, y Â¿procede recurso contra el acto de apertura?

Dichos cuestionamientos serÃ¡n resueltos por el doctor Mauricio Velandia Castro, docente del Departamento de Derecho EconÃ³mico, quien serÃ¡ el cargado de dictar la conferencia.

The Economics Law Department invites to the Study Center "Scope and parameters for behavior to be considered significant and the initiation of the reposition recourse in the opening of an investigation.”

Competition regulations indicate the importance of the Â«significanceÂ» element for the initiation of an investigation. In a recent ruling, the Superintendence of Industry and Commerce indicated that this element is not discussed at the time of the ruling, but at its initiation.

In that sense, under the administrative rule the reposition recourse against the initial investigation action proceeds, as such action is substantively deciding if the investigation is significant. Otherwise, the one being investigated would be without the possibility of opposition. So: what is significant? Does it precede the recourse against the initiation action?

The above questions will be addressed by Doctor Mauricio Velandia Castro, Economics Law Department Professor, who will offer the conference.
